1. Agreement to Terms

Welcome to NirvanaStory. These Terms of Service ("Terms") constitute a legally binding agreement between you and NirvanaStory ("we," "our," or "us") governing your access to and use of the NirvanaStory mobile application, website, and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Important: These Terms include provisions regarding dispute resolution through arbitration (where permitted by law) rather than jury trials or class actions.

2. Description of Service

NirvanaStory is a subscription-based audio streaming service providing original story content for relaxation, sleep, and mindfulness. The Service includes:

• Access to a library of audio stories and content
• Personalized recommendations based on selected topics
• New story releases on a regular schedule
• Offline listening capabilities (for downloaded content)
• Progress tracking and bookmarking features

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. User Accounts

3.1 Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Age Requirements

You must be at least 13 years of age (or 16 in the EU) to use our Service.

3.3 Account Termination

We reserve the right to suspend or terminate your account for violations of these Terms or at our sole discretion.

4. Subscription Terms

4.1 Plans and Pricing

• Monthly: $9.99/month
• Yearly: $64.99/year (save 45%)

Prices are in USD, exclusive of applicable taxes, and subject to change with notice.

4.2 Free Trial

New subscribers may be eligible for a 10-day free trial with full access. A payment method is required. If not cancelled before the trial ends, your subscription converts to paid automatically.

4.3 Concurrent Streams

Each subscription allows up to 3 concurrent streams.

4.4 Billing and Renewal

Subscriptions renew automatically at the end of each billing period. You can cancel through the NirvanaStory app, Apple App Store, Google Play Store, or Stripe portal.

4.5 Cancellation and Refunds

Cancellation takes effect at the end of your current billing period. Refunds are handled by the platform through which you subscribed (Apple, Google, or Stripe).

5. User Conduct

You agree not to:

• Share your account credentials or allow others to use your account
• Circumvent content protection or access controls
• Download, copy, or redistribute content outside the Service
• Reverse engineer or decompile any part of the Service
• Use automated means to access the Service
• Interfere with or disrupt the Service
• Upload viruses, malware, or harmful code
• Use the Service for illegal or unauthorized purposes

6. Intellectual Property

All content is the property of NirvanaStory or its licensors, protected by copyright, trademark, and other IP laws. We grant you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use.

You may not copy, distribute, modify, or create derivative works from any content. Any feedback or suggestions you provide may be used by us without restriction.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIRVANASTORY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID IN THE 12 MONTHS PRIOR, OR (B) $100.

9. Indemnification

You agree to indemnify and hold harmless NirvanaStory from any claims, liabilities, damages, losses, costs, or fees arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved through binding arbitration per the American Arbitration Association rules.

YOU AND NIRVANASTORY AGREE THAT PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS, NOT AS A CLASS ACTION.

11. General Provisions

Third-Party Services: The Service may contain links to third-party services. We are not responsible for their content or practices.

Changes to Terms: We may modify these Terms at any time. Continued use constitutes acceptance.

Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement.

Assignment: You may not assign these Terms without our consent.
